Booking Conditions

The following Booking Conditions, together with the General Information contained on our website and any other written information we bring to your attention before we confirm your booking, form the basis of your contract with Nelson Travel Ltd, also trading as “Nelson Travel”.

Please read them carefully as they set out our respective rights and obligations. By asking us to confirm your booking, you confirm that you have had the opportunity to read and accept these Booking Conditions.

Except where otherwise stated, these Booking Conditions apply to holiday arrangements which you book with us and which we agree to arrange, provide or perform as part of our contract with you.

All references in these Booking Conditions to “holiday”, “booking”, “contract”, “package”, “trip”, “tour” or “arrangements” mean such holiday arrangements unless otherwise stated.

In these Booking Conditions: “you” and “your” means all persons named on the booking, including anyone added or substituted at a later date, or any of them as the context requires; “we”, “us” and “our” means Nelson Travel Ltd; “Package Travel Regulations” means the Package Travel and Linked Travel Arrangements Regulations 2018, as amended or replaced from time to time; “supplier” means any third party providing any part of your arrangements, including airlines, accommodation providers, ground handlers, transfer providers and activity providers; “unavoidable and extraordinary circumstances” means circumstances beyond the control of the party who invokes such circumstances and the consequences of which could not have been avoided even if all reasonable measures had been taken.

Nothing in these Booking Conditions is intended to exclude, restrict or limit any rights which you have under applicable law and which cannot lawfully be excluded, restricted or limited.

‍

1. MAKING YOUR BOOKING

To make a booking, please contact us by telephone or email. All bookings are subject to these Booking Conditions.

The first named person on the booking (“party leader”) must be at least 18 years old and must be authorised to make the booking on behalf of all persons travelling and, where applicable, by the parent or guardian of any traveller under 18.

By making a booking, the party leader confirms that they have this authority and that all members of the party have agreed to be bound by these Booking Conditions.

The party leader is responsible for making all payments due to us and for ensuring that all information supplied to us in relation to the booking is complete and accurate.

A binding contract between us comes into existence when we issue our confirmation invoice to the party leader, unless we have expressly advised you otherwise.

On receiving our confirmation invoice and other travel documents, please check all information carefully, including names, dates, flight details and accommodation.

You must contact us promptly if anything appears incorrect or incomplete.

Where an error results from information supplied by you, you will be responsible for any reasonable costs involved in correcting it.

Where an error was made by us, we will take reasonable steps to correct it without charge to you.

You may contact us by email for any notification required under these Booking Conditions.

‍

2. PAYMENT

In order to confirm your chosen arrangements, a deposit of 30% of the total holiday cost will usually be required at the time of booking.

Certain airlines, accommodation providers and other suppliers require larger deposits, immediate payment or payment in full. In particular, where flights must be ticketed at the time of booking, we may require payment of the full cost of those flights in addition to our normal deposit. We will advise you of any such requirement before your booking is confirmed.

The balance of your holiday cost must be received by us not less than 12 weeks before departure unless a different payment schedule is shown on your confirmation invoice. If you book within 12 weeks of departure, full payment will normally be required at the time of booking.

If we do not receive all payments due in full and on time, we are entitled to treat your booking as cancelled by you. In this event, the cancellation charges set out in Clause 6 will apply.

If we do not cancel immediately because you have indicated that payment will be made, this does not waive our right to treat the booking as cancelled subsequently if payment remains outstanding.

We accept most major credit and debit cards except Diners, Discovery and American Express.

‍

3. YOUR CONTRACT

Where Nelson Travel acts as organiser, your contract is with Nelson Travel Ltd. This contract and all matters arising out of it are governed by English law. You and we agree that any dispute, claim or other matter arising out of or in connection with this contract or your holiday will be dealt with by the Courts of England and Wales, except that if you live in Scotland or Northern Ireland you may bring proceedings in the courts of your home jurisdiction and, where applicable, choose the law of that jurisdiction.

‍

4. THE COST OF YOUR HOLIDAY

The prices shown on our website and in our proposals are based on costs and exchange rates known at the time they are prepared. We reserve the right to make changes and correct errors in advertised or quoted prices before your booking is confirmed.

Pricing Errors‍

We take reasonable care when preparing quotations and confirmation invoices. However, genuine and obvious pricing or calculation errors may occasionally occur. If we become aware of an obvious pricing error before your booking is confirmed, we will advise you of the correct price. If an obvious pricing error is identified shortly after confirmation, we will notify you as soon as reasonably possible.

Where permitted by applicable law, you may choose to accept the corrected price or cancel the affected arrangements and receive a refund of monies paid in respect of them.

Price Changes After Confirmation

Once your package price has been confirmed, we may only increase it where permitted by the Package Travel Regulations and where the increase results directly from a change in:

(a) the price of passenger transport resulting from the cost of fuel or other power sources;

(b) taxes or fees imposed by third parties not directly involved in the performance of the package, including tourist taxes, landing taxes, embarkation or disembarkation fees and government-imposed conservation or national park fees, where falling within this category; or

(c) exchange rates relevant to the package

We will absorb any increase amounting to 2% or less of the total package price, excluding insurance premiums and amendment charges. Where the increase exceeds 2%, we reserve the right to levy a surcharge in accordance with the Package Travel Regulations.

Where we reserve the right to increase your price for the reasons above, you will also be entitled to an appropriate price reduction where the same factors result in a reduction in our relevant costs.

Any increase will be calculated by reference to the actual change in the relevant cost attributable to your booking. We will provide a clear explanation and calculation of any increase.

Where an increase exceeds 8% of the total package price, we will notify you and provide the options required under the Package Travel Regulations, which may include accepting the increase, accepting an alternative package where offered, or terminating the package without paying a termination fee.

No price increase will be imposed within 20 days of departure.

‍

5. CHANGES BY YOU

If you wish to make any change to your confirmed holiday, the party leader must notify us in writing as soon as possible.

Whilst we will endeavour to assist, we cannot guarantee that any requested change will be possible.

Where a change can be made, an amendment fee of £50 per booking or per person, as advised, will be payable together with any additional costs incurred by us and any charges imposed by our suppliers.

For flight-inclusive bookings, you must also pay any airline charges. Many airline tickets are non-refundable and do not permit name changes. A requested change may therefore involve cancellation of the original ticket and purchase of a new ticket.

Transfer of a Package to Another Traveller

Where the Package Travel Regulations apply, you may transfer your booking to another person who satisfies all conditions applicable to the arrangements, provided you give us reasonable notice.

Notice given at least seven days before departure will normally be considered reasonable, although shorter notice may be accepted where practicable.

You and the person to whom the booking is transferred will be jointly responsible for payment of any outstanding balance and any reasonable and actual costs arising from the transfer.

‍

6. CANCELLATION BY YOU

Should you or any member of your party need to cancel your holiday after it has been confirmed, the party leader must notify us in writing. Cancellation will take effect when your written notification is received by us.

As we incur costs from the time your booking is confirmed and many of our suppliers impose substantial cancellation charges, the following cancellation charges will normally apply:

84 days or more before departure: Deposit

83 days or fewer before departure: 100% of the total holiday price

Where you have paid the full cost of flights or another non-refundable service at the time of booking, we will also be entitled to retain the non-refundable cost of those services where this is not already included in the cancellation charge above.

These cancellation charges represent our reasonable estimate of the costs and losses we are likely to incur as a result of cancellation.

Where required by applicable law, the termination fee applied to your booking will take account of cost savings and income from any alternative deployment of the relevant travel services.

Upon request, we will provide an explanation of how the applicable termination fee has been calculated where required by law.

Depending upon the reason for cancellation, you may be able to reclaim cancellation charges, less any applicable excess, under your travel insurance policy.

Where cancellation by one or more members of your party reduces the number of travellers below the number upon which the price, room occupancy, group rate, discount or concession was based, we reserve the right to recalculate the price payable by the remaining travellers.

Cancellation Due to Unavoidable and Extraordinary Circumstances

Where the Package Travel Regulations apply, you may terminate your package before departure without paying a termination fee where unavoidable and extraordinary circumstances occur at the destination or its immediate vicinity and significantly affect the performance of the package or the carriage of passengers to the destination. Any entitlement to a refund in these circumstances will be determined in accordance with applicable law.

‍

7. TRAVEL INSURANCE

It is a condition of booking that you obtain adequate and appropriate travel insurance from the time your holiday is confirmed and maintain it for the duration of your trip. Your policy should, as appropriate to your arrangements, provide adequate cover for: cancellation and curtailment; emergency medical expenses and repatriation; personal belongings; travel delay; missed departure and missed connections; additional accommodation and transport expenses; and any activities you intend to undertake. It is your responsibility to ensure that your policy is suitable for your personal circumstances and that its financial limits are sufficient for the value of your arrangements.

This is particularly important where your itinerary includes high-value accommodation, safari lodges, private villas, charter flights or other arrangements which may be non-refundable if missed as a result of flight delay, cancellation, missed connections or other travel disruption.

‍

8. CHANGES AND CANCELLATION BY US BEFORE DEPARTURE

We begin planning holidays many months in advance. Occasionally, we may need to make changes to confirmed arrangements or, very rarely, cancel a booking. We reserve the right to make changes where necessary.

Minor Changes

Most changes are minor. Examples may include a small change to flight times, a change of aircraft type, a change of operating carrier or the substitution of accommodation with another of a comparable standard and location where the overall effect upon your holiday is insignificant. Where permitted by applicable law, we reserve the right to make insignificant changes to your arrangements and will notify you of them in a clear and understandable manner.

Significant Changes

Occasionally, we may need to make a significant change to one or more of the main characteristics of your package. Whether a change is significant will depend upon the circumstances of the booking and the information you provided to us which we could reasonably be expected to have taken into account when the booking was made.

Examples may include:

a significant change in accommodation standard or location for a substantial part of your trip;

a significant change in the overall duration of your holiday;

a substantial change to your departure or arrival arrangements; or

a significant change to an itinerary resulting in the omission of an important destination or substantial element of the trip.

If we are required to make a significant change, we will inform you without undue delay and, where required by applicable law, give you the choice of:

accepting the proposed change;

accepting an alternative package where we are able to offer one; or

terminating the package and receiving the refund required by law.

Where an alternative package is of a lower quality or cost, you will be entitled to an appropriate price reduction.

Cancellation by Us

We reserve the right to cancel your booking where permitted by applicable law. Where we cancel your package, we will provide the refund and, where applicable, compensation required by the Package Travel Regulations. We will not be required to pay additional compensation where cancellation results from unavoidable and extraordinary circumstances or another statutory exception applies.

Compensation for Changes Before Departure

Where applicable, compensation for a significant change or cancellation by us will be assessed in accordance with applicable law and the circumstances of the booking. No compensation for damages will be payable where the relevant statutory defence applies, including where the change or cancellation results from unavoidable and extraordinary circumstances.

‍

9. PERFORMANCE OF YOUR PACKAGE

Where Nelson Travel is the organiser of your package, we are responsible for the performance of the travel services included in your package in accordance with the Package Travel Regulations, including where those services are provided by another travel service provider.

If, during your holiday, any part of your package is not provided as agreed, you must let us know without undue delay and give us a reasonable opportunity to investigate and, where appropriate, resolve the problem.

Where the problem can reasonably be remedied, we will endeavour to do so. We will not be required to remedy a problem where doing so is impossible or would involve disproportionate costs, taking into account the circumstances and the value of the services affected.

Where a significant part of your package cannot be provided as agreed, we will, where required by law and where possible, arrange a suitable alternative at no additional cost to you. Where possible, this will be of an equivalent or higher standard. If the alternative is of a lower quality, you will be entitled to an appropriate price reduction.

Any entitlement to a price reduction or compensation will be determined in accordance with the Package Travel Regulations.

‍

10. FLIGHT DISRUPTION, DELAYS AND MISSED SERVICES

Flights are operated by independent airlines and may be affected by delays, cancellations, schedule changes, air traffic control restrictions, adverse weather, technical or operational problems, industrial action, airport disruption, security incidents and other events.

Where applicable passenger-rights legislation applies, including UK261 or equivalent legislation in another jurisdiction, you may have rights directly against the operating airline. Depending upon the circumstances, these may include rerouting, reimbursement, meals, refreshments, overnight accommodation and/or compensation.

You are responsible for pursuing payments and compensation which are payable directly by the airline, although we will provide reasonable assistance where appropriate.

If a flight delay, cancellation, missed connection or other transport disruption is likely to affect any subsequent part of an itinerary arranged by us, you must contact Nelson Travel as soon as reasonably possible. This is particularly important where disruption may affect onward flights, transfers, accommodation or other time-sensitive services.

Where reasonably possible, we will seek to minimise the effect of the disruption. Depending upon the circumstances, this may include liaising with the airline, our ground handler or other suppliers; rearranging transfers; changing internal flights or other transport; altering the sequence of an itinerary; seeking to move an unused accommodation night or service; negotiating with suppliers to waive or reduce charges; or arranging suitable alternative services.

You should not independently cancel, rearrange or purchase replacements for services forming part of your package without consulting us where it is reasonably possible to do so. Where you independently alter arrangements without giving us a reasonable opportunity to assist or remedy the situation, we will not be responsible for avoidable additional losses or expenses resulting from your decision, except where applicable law provides otherwise.

You agree to cooperate reasonably with measures intended to minimise the effect of disruption.

‍

11. RECOVERY FROM AIRLINES & SUPPLIERS

Where a third party has agreed to provide a travel service which forms part of your package and fails to perform or cancels all or part of that service, we reserve all rights to obtain any refund or other remedy available to us under the Package Travel Regulations or otherwise at law.

Where an act, omission, cancellation or failure of an airline, accommodation provider, ground handler or other third party, we reserve all rights of redress and recovery available to us under the Package Travel Regulations and otherwise at law, including, in respect of package contracts to which they apply, the rights provided by Regulations 29A and 29B.

Your rights against an airline under applicable passenger-rights legislation are separate from your rights under the Package Travel Regulations. However, you are not entitled to recover more than once in respect of the same loss, and any payment received from an airline or other travel service provider will be taken into account where required by applicable law to avoid overcompensation.

‍

12. UNAVOIDABLE AND EXTRAORDINARY CIRCUMSTANCES

Except where otherwise provided by applicable law, we will not be liable to pay compensation for damages where the failure to perform or properly perform your arrangements results from unavoidable and extraordinary circumstances.

These may include, without limitation, war or threat of war, serious security problems, terrorism, civil unrest, significant risks to human health, outbreaks of serious disease, epidemics or pandemics, natural disasters, fire, flood, extreme weather conditions, closure or restriction of airports or airspace and other circumstances beyond the control of the party relying upon them where the consequences could not have been avoided even if all reasonable measures had been taken.

The existence of unavoidable and extraordinary circumstances does not remove any right to a price reduction where such a right applies under the Package Travel Regulations.

‍

13. OUR LIABILITY TO YOU

Where we act as organiser of your package, we accept responsibility for the performance of the travel services included in the package as required by the Package Travel Regulations.

You must inform us without undue delay of any lack of conformity which you perceive during your trip so that we have a reasonable opportunity to investigate and, where appropriate, remedy it.

Compensation for Damages

You will not be entitled to compensation for damages where we prove that the lack of conformity is:

(a) attributable to you;

(b) attributable to a third party unconnected with the provision of the travel services included in your package and is unforeseeable or unavoidable; or

(c) due to unavoidable and extraordinary circumstances.

Nothing in these Booking Conditions limits or excludes liability which cannot lawfully be limited or excluded.

Services Outside Our Contract

We cannot accept responsibility for services which do not form part of our contract with you.

This includes services, facilities, excursions and activities which you independently purchase from a hotel, local operator or other third party and which are not included in the package we have agreed to provide.

Local Standards

The services included in your holiday will generally be subject to the laws, regulations and standards applicable in the country in which they are provided. Those standards may differ from those applicable in the UK. Compliance with applicable local standards will be relevant when determining whether a service has been properly performed, although nothing in this provision limits our statutory obligations as package organiser.

International Conventions and Carrier Liability

Where a claim concerns transport by air, sea or rail or another service governed by an applicable international convention or legislation, our liability will be limited to the same extent as the liability of the relevant travel service provider where permitted by law.

Applicable conventions may include the Montreal Convention in relation to international carriage by air, the Athens Convention in relation to carriage by sea and COTIF in relation to carriage by rail.

Where a carrier would not be required to make a payment under an applicable convention or regulation, we will be entitled to rely upon the same defence where permitted by law.

Any payment received from a carrier or other provider in respect of the same loss may be deducted from an amount payable by us to prevent double recovery.

Limitation of Liability

In relation to claims which do not involve personal injury or damage caused intentionally or with negligence and which are not subject to a lower limitation under an applicable international convention, our liability may, where permitted by law, be limited to a maximum of three times the total price of the package.

Nothing in this provision limits any liability which cannot lawfully be limited.

We will not be responsible for losses:

(a) which did not result from a breach of contract or other fault for which we are legally responsible;

(b) which could not reasonably have been foreseen on the basis of the information supplied to us before the booking was made; or

(c) which relate to a business activity, including loss of profit, revenue, opportunity or earnings.

‍

14. YOUR DUTY TO MINIMISE LOSS

If a problem occurs during your holiday, you must take reasonable steps to minimise unnecessary loss or expense.

This includes notifying us promptly, cooperating with reasonable alternative arrangements and, where appropriate, seeking assistance or benefits available from an airline, carrier, insurer or other provider.

We will not be responsible for losses which could reasonably have been avoided or reduced by appropriate action on your part.

Nothing in this clause requires you to waive any statutory right or incur unreasonable expense.

15. COMPLAINTS AND PROBLEMS

If you experience a problem during your holiday, you must notify us and, where appropriate, the relevant supplier without undue delay.

This gives us the opportunity to investigate and, where possible, resolve the problem while you are travelling.

Most problems can be resolved quickly if we are told about them at the time.

If you remain dissatisfied after returning home, please write to us as soon as reasonably possible, preferably within 28 days of your return, quoting your booking reference and providing full details.

Failure to notify us of a problem while you are away may affect our ability to investigate or remedy it and may be taken into account when assessing any resulting loss or claim.

Nothing in this clause removes any statutory right which cannot lawfully be excluded.

‍

16. BEHAVIOUR

When you book with us, you accept responsibility for the conduct of yourself and all members of your party.

You are responsible for any damage or loss deliberately or negligently caused by you or a member of your party.

You must pay the relevant accommodation provider or other supplier for any such damage or loss where reasonably required. If a claim is subsequently made against us as a result of your actions, you will be responsible for reimbursing us for the reasonable costs and losses we incur, including reasonable legal costs where applicable.

We expect all clients to show consideration for other people.

If, in our reasonable opinion or the reasonable opinion of a supplier or other person in authority, you or any member of your party behaves in a way which causes or is likely to cause danger, significant distress or disruption to others, or significant damage to property, we may terminate the arrangements of the person concerned where it is reasonable to do so.

In such circumstances, we will have no further responsibility for the person concerned except to the extent required by applicable law.

‍

17. CONDITIONS OF SUPPLIERS

Many of the services which make up your holiday are provided by independent suppliers.

Those suppliers provide their services in accordance with their own terms and conditions. Some of those terms may limit or exclude the supplier’s liability in accordance with applicable law or international conventions.

Copies of relevant supplier terms and conditions are available on request where reasonably available to us.

Supplier conditions do not reduce any statutory responsibility which Nelson Travel has to you as organiser of a package.

‍

18. SPECIAL REQUESTS, MEDICAL CONDITIONS AND ACCESSIBILITY

If you have a special request, please advise us in writing at the time of booking.

We will endeavour to pass reasonable requests to the relevant supplier but cannot guarantee that a request will be met unless we have specifically confirmed it in writing as part of your contract.

The fact that a request appears on your confirmation or has been passed to a supplier does not, by itself, mean that the request is guaranteed.

We cannot accept a booking which is expressly conditional upon fulfilment of a request unless we have agreed to this in writing.

If you or any member of your party has a disability, reduced mobility, medical condition, dietary requirement or other requirement which may affect the suitability or performance of your arrangements, please tell us before booking.

You must provide sufficient information to enable us and the relevant suppliers to assess whether the arrangements are suitable and to make reasonable preparations where appropriate.

You must also notify us promptly if a relevant condition or requirement changes after your booking has been confirmed.

‍

19. EXCURSIONS, ACTIVITIES AND WEBSITE INFORMATION

Our website and proposals may refer to excursions, restaurants, activities and other services available in the areas you visit.

Where such a service is not included in your confirmed arrangements and you purchase it independently from a local operator or other third party, it does not form part of our contract with you.

This remains the case where we have provided information about the service or suggested a particular provider, unless we have expressly agreed to include and provide the service as part of your package.

Where we merely assist you in making an independent booking with a third party, we will make the capacity in which we are acting clear where appropriate.

Where an excursion or activity is expressly included in your confirmed package, our responsibilities as package organiser will apply in accordance with applicable law.

‍

20. PASSPORTS, VISAS, ENTRY AND HEALTH REQUIREMENTS

It is your responsibility to ensure that every member of your party complies with all passport, visa, immigration, health and other entry requirements applicable to their nationality, individual circumstances, destination and any country through which they transit.

Requirements can change at short notice.

We may provide general information and guidance to assist you, but you remain responsible for checking the current official requirements applicable to you in sufficient time before travel.

You must ensure that you have the necessary passports, visas, permits, vaccinations, health certificates and other documentation required for your journey.

You should seek appropriate professional medical advice regarding vaccinations, preventative medication and other health considerations relevant to your destination and personal circumstances.

If you or any member of your party is unable to travel, board transport or enter or transit a country because you have failed to comply with an applicable requirement, we cannot accept responsibility for the resulting loss or expense except where the failure results from incorrect information which we were legally required to provide and upon which you reasonably relied.

Where your failure to hold the required documentation results in a fine, surcharge or other financial penalty being imposed upon us, you will be responsible for reimbursing us for the reasonable amount incurred.

‍

21. FINANCIAL SECURITY AND ATOL

Where your confirmed travel arrangements are ATOL protected, they are financially protected through Nelson Travel Ltd’s Air Travel Organiser’s Licence, ATOL number 12034.

When you buy an ATOL protected flight or flight inclusive holiday from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong.

We, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable).

If we, or the suppliers identified on your ATOL Certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme.

You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us or your credit card issuer where applicable.

You also agree that any such claims may be re-assigned to another body if that other body has paid sums you have claimed under the ATOL scheme.

Where required by the CAA’s current ATOL Standard Terms, any additional prescribed financial-protection wording will apply.

‍

22. FLIGHTS

We will advise you of the identity of the operating air carrier where required by applicable law.

Where the actual carrier is not known at the time of booking, we will advise you of the likely carrier and will inform you of the actual carrier as soon as we become aware of it.

Flight times may change between booking and departure. Airlines control their own schedules and may change flight times, routing, aircraft type and operating carrier for operational or other reasons.

We will notify you of material changes of which we become aware.

A change of carrier, flight time or aircraft type will not automatically entitle you to cancel your arrangements without charge. Your rights will depend upon the nature and significance of the change and applicable law.

Fare Type

Unless otherwise stated, the airline fares used in our quotations and bookings are non-refundable and non-changeable once tickets have been issued. Airline fare rules are set by the airline and are outside our control. Where more flexible fares are available, we will be happy to advise you of these on request, although they may carry a higher cost.

Seat Selection

Seat selection is not included unless explicitly stated. Where we assist with a seat request or seat selection, seating remains subject to airline availability and operational requirements. Airlines may change allocated seats, aircraft or cabin configuration and we cannot guarantee any particular seat unless the airline itself provides such a guarantee.

Connecting Flights

Where connecting flights or other transport have been arranged by Nelson Travel as part of your package, our statutory obligations as package organiser apply. Where you independently book transport which connects with arrangements made by us, you are responsible for ensuring that you allow sufficient time for the connection and for the consequences of delay to independently booked services, except to the extent that we are otherwise legally responsible. You must inform us as soon as reasonably possible of delays, cancellations or changes which may affect onward arrangements so that we can assist where appropriate.

‍

23. SAFETY AND LOCAL STANDARDS‍

The laws, regulations, customs and safety standards applicable to services overseas may differ from those in the UK. Accommodation, transport, activities and other services may therefore operate to different standards from those you are accustomed to at home. This does not reduce any responsibility which we have to you under applicable law. You must follow reasonable safety instructions provided by us, our suppliers, guides and other persons responsible for the operation of your arrangements.

‍

24. TRAVEL ADVICE

Official travel advice and entry or security conditions can change, sometimes at short notice.

You should consult the current official travel advice issued by the relevant government authority for your nationality and destination before booking and again before travelling. UK travellers should consult the Foreign, Commonwealth & Development Office travel advice where appropriate. You remain responsible for deciding whether you wish to travel unless applicable law provides you with a right to cancel or change your arrangements.

‍

25. WEBSITE AND INFORMATION ACCURACY‍

We make reasonable efforts to ensure that information on our website, in proposals and in other materials is accurate when published or supplied.

Travel services can change and facilities, activities, routes, schedules, accommodation details and other information may subsequently be altered by suppliers.

We will notify you of material information or changes of which we become aware and which we are required to communicate to you

‍

26. ASSISTANCE WHILE YOU ARE AWAY

If you experience difficulty while travelling, please contact us using the contact details supplied with your travel documents.

Where you are in difficulty and the Package Travel Regulations require us to provide assistance, we will do so without undue delay.

Depending upon the circumstances, this may include providing information regarding health services, local authorities or consular assistance, assisting with communications and helping you to find alternative travel arrangements.

Where the difficulty is caused intentionally by you or through your negligence, we may charge a reasonable fee for assistance where permitted by law. Any fee will not exceed the actual costs we incur.

‍‍

If any provision of these Booking Conditions is found to be invalid, unlawful or unenforceable, that provision will be treated as modified to the minimum extent necessary or, where modification is not possible, removed.

The remaining provisions will continue to apply.

Nothing in these Booking Conditions affects any statutory consumer right which cannot lawfully be excluded, restricted or waived.

27. SEVERABILITY AND STATUTORY RIGHTSIf any provision of these Booking Conditions is found to be invalid, unlawful or unenforceable, that provision will be treated as modified to the minimum extent necessary or, where modification is not possible, removed.
